The Website serves as a central digital platform for Phase V Automotive and its associated dealerships, divisions, brands, accident repair centres, and associated automotive operations.

These Terms and Conditions (“Terms”) are binding and enforceable against every person that accesses or uses this Website (“you”, “your” or “user”).

By accessing or using the Website, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must discontinue use of this Website immediately.

These Terms govern your access to and use of the Website, which advertises new and used vehicles, facilitates booking of test drives and vehicle servicing, enables submission of information for the potential sale of user-owned vehicles, facilitates accident repair enquiries, and supports applications for vehicle financing through third-party providers.

1. Definitions

For the purposes of these Terms:

1.1 Applicable Law means any statute, law, ordinance, regulation, rule, code, directive, judgment, decree, treaty, or other requirement of any international, national, provincial, or local government authority, agency, court, or other governmental body having jurisdiction, as may be in force from time to time.

1.2 Intellectual Property means any know-how, invention, design, trademark, copyright material, process, methodology, and all other identical or similar intellectual property, whether registered or unregistered.

1.3 Intellectual Property Rights means all proprietary rights or any right, title, authority, or entitlement held in respect of Intellectual Property, whether under licence or otherwise.

1.4 Personal Information means any information relating to an identifiable person, including race, gender, age, health, religion; education, medical, financial, criminal or employment history; identifying numbers, email/physical addresses, telephone numbers or biometric information; and personal opinions, views, preferences or confidential correspondence.

1.5 Services means the functionalities provided by the Website, including browsing vehicle listings, booking test drives, scheduling vehicle servicing, submitting vehicle sale or valuation information, submitting accident repair enquiries, subscribing to communications, and applying for vehicle financing through third-party providers.

1.6 Dealership means any dealership, division, repair centre, subsidiary, associated entity, or operating business forming part of the Phase V Automotive group from time to time.

1.7 Group Entity means any company, dealership, subsidiary, division, affiliate, or associated entity owned, operated by, managed by, or associated with Phase V Automotive.

1.8 Associated Services means any services offered through the Website, including vehicle sales, vehicle sourcing, test drives, servicing, accident repair services, finance facilitation, trade-ins, vehicle valuations, auctions, fleet services, communications, CRM-related interactions, and related automotive ownership services.

2. General Information

2.1 Purpose

The Website serves as a central digital platform for Phase V Automotive and its associated Dealerships. It displays new and used vehicles including images, specifications and pricing, facilitates booking test drives and vehicle servicing, enables accident repair and valuation enquiries, supports trade-in and vehicle sale submissions, and facilitates finance applications through third-party providers. The Website does not facilitate direct online vehicle purchases unless expressly stated otherwise.

2.2 Eligibility

You must be at least 18 years old to use the Website. If under 18, you may use the Website only with a parent or guardian’s consent and involvement.

2.3 Authority

You warrant that your actions on the Website are authorised by your organisation, if applicable, and you agree to comply with all internal and external requirements that apply to the organisation that you represent.

2.4 Access Restrictions

We reserve the right to restrict, suspend, or terminate access to the Website if we reasonably believe your use violates these Terms, is excessive, unlawful, or negatively impacts other users’ experience.

2.5 Necessary Action

3. Use of the Website

3.1 Permitted Use

You may browse vehicle listings, view specifications, prices and images, book test drives, schedule vehicle servicing, submit valuation or vehicle sale information, enquire about accident repair services, subscribe to communications, and apply for vehicle financing through the Website.

3.2 Prohibited Use

You may not:

  • use the Website irresponsibly or in violation of Applicable Law
  • engage in illegal, threatening, abusive, harmful, harassing, defamatory, obscene, or racially offensive activities
  • use automated means (bots, spiders, scrapers) to monitor, access, or collect content without our prior written permission
  • transmit harmful code or attempt unauthorised access to the Website, its servers, or related systems
  • modify, adapt, decompile, reverse engineer, or create derivative works from the Website’s software, code, or content
  • post or transmit unlawful, defamatory, pornographic, or otherwise objectionable material

4. Vehicle Listings

We strive to ensure vehicle pictures, specifications and prices are accurate but provide no warranties as to their completeness, accuracy or reliability. Vehicle availability and prices are subject to change without notice. Images may differ from actual specifications, trim, colours, accessories, optional extras or stock. Mileage on demo, used or pre-owned vehicles may change without notice. Specifications, pricing, promotions, finance estimates and availability may change due to manufacturer adjustments, market conditions, exchange rates, stock or dealership factors. Errors and omissions excepted (“E&OE”). The Website does not facilitate direct vehicle purchases unless expressly stated otherwise; all purchase transactions remain subject to dealership processes, applicable agreements and final confirmation by the relevant Dealership.

5. Test Drive and Servicing Bookings

Booking a test drive or servicing requires your name, contact information, preferred date and time, and is subject to our confirmation and availability. You warrant you are the legal owner or duly authorised to act on behalf of the owner of any vehicle booked for servicing. To cancel or reschedule, contact us through the channels on the Website; we may cancel or reschedule due to unforeseen circumstances with reasonable notice where possible. These Terms are to be read with any additional terms agreed when test driving, servicing, repairing or purchasing at a Dealership; in the event of conflict, the latter prevails. Certain servicing, repair or maintenance may be performed by specialised facilities, manufacturer-approved Accident Repair Centres, or third-party providers associated with Phase V Automotive.

6. Accident Repair Centre Services

Phase V Automotive may facilitate accident repair, panel beating, paintwork, structural repair, calibration, assessment and associated services through its manufacturer-approved Accident Repair Centres and repair partners. Repair timelines are estimates only and may be impacted by insurer approvals, parts availability, supplementary damage assessments, manufacturer requirements, specialist services or circumstances beyond our control. Additional damage identified during repair may impact costs, scope, insurer approvals or timelines. Repairs may involve OEM, approved equivalent, remanufactured, insurer-approved or alternative components. While we may assist with insurer communication and claims administration, the insurance relationship remains solely between you and your insurer. We reserve the right to charge reasonable storage fees for vehicles not collected within a reasonable period. Vehicles should be inspected on collection and any concerns reported within a reasonable period.

7. User-Submitted Vehicle Sale Information

You may submit information about a vehicle you wish to sell (make, model, year, condition, mileage, ownership status, asking price) through the designated form. You must provide accurate, complete and truthful information and have the legal right or authority to sell the vehicle. Submitted information may be displayed on the Website or shared with potential buyers, Dealerships, Group Entities, valuation partners or associated service providers to facilitate a sale, valuation, trade-in or auction-related process. You are solely responsible for the accuracy, completeness and legality of the information provided, including ownership, title status, finance obligations and any liens. You must promptly inform us if the vehicle is sold, no longer available, or if information changes, and warrant the vehicle is free from legal restrictions preventing sale. Any valuation generated is indicative only and subject to physical inspection, ownership verification, condition, market conditions, finance settlement verification and final dealership assessment. Participation does not guarantee sale, purchase, reserve achievement or transaction completion. We may edit, moderate or remove your listing at our discretion. We are not liable for disputes, losses or damages arising from your submission, including inaccurate information, misrepresentation, failure to disclose material facts, or failure to complete a sale.

8. Finance Applications

You may apply for vehicle financing through the Website by submitting required information, including Personal Information and financial details, to third-party finance providers. Finance applications are subject to the terms, conditions and approval processes of the respective provider. Any instalment calculations, repayment examples, finance estimates, balloon examples or affordability indications are illustrative only and do not constitute financial advice, quotations, approvals or guarantees. You must provide accurate information and comply with Applicable Law, and you consent to the sharing of your Personal Information with third-party finance providers for processing; once submitted, it is processed in accordance with that provider’s policy. Finance applications may require affordability assessments, credit bureau checks, fraud prevention, identity verification and supporting documentation. We act solely as an intermediary and do not provide financing or guarantee approval unless expressly stated. We are not responsible for the terms, interest rates, approvals, declines or outcomes of any application, and any finance agreement is solely between you and the provider.

9. Third-Party Service Providers

We may use third-party providers for Website functionalities and to provide the Services, including data processing, finance application processing, vehicle listing management, CRM, analytics, marketing, valuation tools, communication systems and repair-related services. These may include finance houses, insurers, CRM providers, analytics providers, listing platforms, communication platforms, OEM systems, valuation systems, marketing platforms, website technology providers and associated automotive service providers. By using our Services you acknowledge that the terms and policies of these providers may apply to you. We take reasonable steps to ensure they adhere to applicable data security and privacy standards but are not liable for loss, damage or unauthorised access resulting from their actions or negligence, except where liability cannot be excluded under Applicable Law.

10. Third-Party Content

The Website may include links to third-party websites, services, platforms, advertisements or content (“Third-Party Content”). We do not control, endorse or verify Third-Party Content, and your use of it is at your own risk. Third-Party Content does not represent our views or opinions.

11. User-Generated Content

By submitting vehicle sale information, finance applications, reviews, comments or other content (“User-Generated Content”), you grant us a non-exclusive, royalty-free, worldwide, perpetual licence to use, modify, reproduce and display such content on the Website or share it with third parties for the purposes of providing the Services. Content must not be unlawful, offensive, defamatory or infringe third-party rights; we may remove or moderate content at our discretion. You are solely responsible for the accuracy, legality and appropriateness of your User-Generated Content and any consequences arising from its submission or use.

12. Intellectual Property

All Website content, including text, images, logos, designs, graphics, layouts, software and other materials, is owned by or licensed to us and protected by Intellectual Property Rights. You may not reproduce, distribute, modify, decompile, reverse engineer or create derivative works from Website content without our written consent, except for personal, non-commercial use as permitted by Applicable Law. Marketing communications will only be sent where appropriate consent has been obtained or another lawful basis exists, and will contain an unsubscribe mechanism. The Website uses cookies, analytics, tracking, remarketing and behavioural monitoring technologies (including Google Analytics, Google Tag Manager, Meta Pixel, Hotjar, CRM integrations) to improve functionality, measure performance, personalise content and support marketing; further information is in our Cookie Policy, which forms part of these Terms. Your Personal Information may be shared between Group Entities, Dealerships, OEM partners, finance providers, insurers, CRM systems, analytics providers, marketing platforms, listing providers and associated service providers where necessary. We implement reasonable measures to protect your Personal Information but cannot guarantee absolute security.

14. Disclaimers

The Website and its content are provided “as is” without warranties, express or implied, regarding accuracy, completeness, availability, security or reliability. Content, including vehicle listings, finance information, valuations and repair information, is for general information only and is not professional, technical, financial or legal advice. To the fullest extent permitted by Applicable Law, we do not warrant or accept liability for the completeness, accuracy or timeliness of content; harm to your computer system or data loss; deletion or failure to store or transmit data; uninterrupted, secure or error-free access; or losses caused by events beyond our control. Nothing in these Terms limits your rights under the Consumer Protection Act or other Applicable Law where such rights cannot be excluded.

15. Limitation of Liability

Your use of the Website is at your sole risk and is provided on an “as is” and “as available” basis. We disclaim all warranties (express, implied, oral or written), including merchantability, fitness for a particular purpose and non-infringement, to the fullest extent permitted by Applicable Law. 17. Governing Law and Dispute Resolution

These Terms are governed by the laws of South Africa, without regard to conflict of law principles. Any disputes shall be resolved through arbitration in Johannesburg under the rules of the Arbitration Foundation of Southern Africa (AFSA), or at our discretion in the courts of Johannesburg. Nothing in this clause limits your rights under the Consumer Protection Act, POPIA or other Applicable Law to approach a competent court, ombud, regulator, tribunal or consumer authority.

18. Updates and Modifications

We may update these Terms, with changes posted on this page and an updated “Last Updated” date. Continued use after changes constitutes acceptance of the revised Terms, and you are responsible for regularly reviewing them. We reserve the right to modify or discontinue any aspect or feature of the Website at any time without notice.

If any provision is found invalid or unenforceable, the remaining provisions remain in full force. Our failure to enforce any right or provision is not a waiver. We may assign these Terms without your consent; you may not assign yours without our prior written consent. We are not liable for any failure to perform due to events beyond our reasonable control (acts of God, strikes, network failures, system outages, supplier delays, regulatory changes). Nothing in these Terms creates a partnership, joint venture, agency or employment relationship between you and Phase V Automotive.
